1. Agreement to Terms

Welcome to Wild BBQ. These Terms and Conditions ("Terms") govern your access to and use of our website, online ordering system, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use our Services. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of our Services after any changes constitutes acceptance of the modified Terms.

2. Eligibility

By using our Services, you represent and warrant that:

• You have the legal capacity to enter into a binding contract (or have parental/guardian consent)
• You will use the Services only for lawful purposes
• All information you provide is accurate and complete

3. Using Our Services

No account or login is required to place orders. When using our Services:

• You must provide accurate contact information (name, email, phone number)
• You can optionally use Google OAuth to auto-fill your email address for convenience
• You are responsible for the accuracy of all information you provide
• You must provide a valid email address to receive order confirmations and updates
• You are responsible for all orders placed using your contact information
• We reserve the right to refuse service or cancel orders that violate these Terms

If you choose to use Google OAuth to auto-fill your email, we only access your email address for this purpose. We do not create an account, store passwords, or maintain login sessions.

4. Orders and Payments

4.1 Placing Orders

Our pre-order system allows you to schedule pickup orders up to 42 days in advance. When placing an order:

• You must select a valid pickup date and time window
• Orders are available for pickup Thursday through Sunday only
• All orders must be placed at least 3 days in advance
• You must provide accurate contact and pickup information

4.2 Payment

All orders require full payment at the time of order placement:

• Payment is processed securely through Stripe
• We accept major credit and debit cards
• Prices are listed in US Dollars and include applicable taxes
• Payment must be authorized before your order is confirmed
• You authorize us to charge the payment method provided for the total order amount

4.3 Order Confirmation

Once your order is successfully placed and payment is processed, you will receive:

• An order confirmation email with your order details
• A unique order tracking number
• Pickup instructions and location information

4.4 Pricing

We reserve the right to:

• Change prices at any time without prior notice
• Correct pricing errors, even after an order has been placed
• Limit quantities available for purchase
• Refuse or cancel orders in our sole discretion

If a pricing error is discovered after you have placed an order, we will contact you and give you the option to proceed at the correct price or cancel the order for a full refund.

5. Cancellation and Refund Policy

5.1 Cancellation by Customer

Orders may be cancelled under the following conditions:

• More than 48 hours before pickup: Full refund minus a 5% processing fee
• 24-48 hours before pickup: 50% refund of the order total
• Less than 24 hours before pickup: No refund available

To cancel an order, please contact us as soon as possible using your order tracking number.

5.2 Cancellation by Wild BBQ

We reserve the right to cancel orders in the event of:

• Product unavailability or shortages
• Equipment failure or unforeseen circumstances
• Severe weather or emergency situations
• Suspected fraud or unauthorized transactions

If we cancel your order, you will receive a full refund to your original payment method within 5-10 business days.

5.3 No-Show Policy

If you fail to pick up your order during the scheduled time window without prior cancellation, no refund will be provided. We will attempt to contact you and hold the order for up to 2 hours after your scheduled pickup time.

6. Pickup and Fulfillment

When picking up your order:

• Orders must be picked up at: 601 W University Drive
• Arrive during your scheduled pickup time window
• Bring your order confirmation or tracking number
• Valid photo ID may be required
• Inspect your order before leaving; we cannot accommodate changes after pickup
• Hot food items should be consumed or refrigerated promptly

7. Food Safety and Allergies

Important Notice:

• Our kitchen handles various allergens including gluten, soy, dairy, and nuts
• Cross-contamination may occur despite our best efforts
• We cannot guarantee any item is completely allergen-free
• If you have food allergies or dietary restrictions, please contact us before ordering
• You are responsible for informing us of any allergies or dietary requirements

By placing an order, you acknowledge these risks and agree that Wild BBQ is not liable for allergic reactions or dietary issues.

8. Quality and Satisfaction

We take pride in the quality of our food. If you are not satisfied with your order:

• Contact us within 24 hours of pickup
• Provide your order number and photos if applicable
• Describe the issue in detail

We will review your complaint and may offer a refund, credit, or replacement at our discretion. We do not guarantee refunds for subjective taste preferences.

9. Intellectual Property

All content on our website, including but not limited to text, graphics, logos, images, recipes, and software, is the property of Wild BBQ or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, reproduce, or distribute our content without permission
• Use our trademarks or branding without authorization
• Create derivative works based on our content
• Use automated systems to scrape or extract data from our website

10. User Conduct

You agree not to:

• Use the Services for any illegal or unauthorized purpose
• Violate any laws or regulations
• Impersonate any person or entity
• Transmit viruses, malware, or harmful code
• Interfere with the proper functioning of the Services
• Attempt to gain unauthorized access to our systems
• Harass, abuse, or harm other users or our staff
• Engage in fraudulent activities or chargebacks

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Wild BBQ and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability for any claim arising from these Terms or your use of our Services shall not exceed the amount you paid for the specific order in question
• We are not responsible for delays or failures due to circumstances beyond our reasonable control (force majeure)
• We do not guarantee uninterrupted or error-free service

12. Indemnification

You agree to indemnify, defend, and hold harmless Wild BBQ, its owners, employees, contractors, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your violation of these Terms
• Your violation of any rights of another party
• Your use or misuse of the Services
• Your breach of any representations or warranties

13. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability and fitness for a particular purpose
• Warranties regarding accuracy, reliability, or completeness of content
• Warranties that the Services will be uninterrupted or error-free
• Warranties regarding the security of data transmission

14. Third-Party Services

Our Services integrate with third-party providers (such as Stripe for payment processing and Google for authentication). We are not responsible for:

• The availability or performance of third-party services
• Third-party terms, policies, or practices
• Any losses or damages resulting from third-party services

Your use of third-party services is subject to their respective terms and conditions.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the state where Wild BBQ operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of our Services shall be resolved through:

• Informal Resolution: We encourage you to contact us first to resolve any issues
• Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration
• Class Action Waiver: You agree to resolve disputes on an individual basis and waive the right to participate in class actions

16. Termination

We reserve the right to suspend or terminate your access to our Services at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or suspicious activity
• Requests by law enforcement or government agencies
• Discontinuation of the Services

Upon termination, your right to use the Services will immediately cease. Sections of these Terms that by their nature should survive termination shall survive.

17. Privacy

Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
